This should do it:

If FileExists("FilePath\file.ext") Then


       FileDelete("FilePath\file.ext")

       ;code for download

Else

       ;place your code for download

That may fail flat on its nose and duplicates the download part uselessly.

Always check for errors!

If FileExists("FilePath\file.ext") Then
 Local $ret = FileDelete("FilePath\file.ext")
 If Not $ret Then
 ; inform user of error and exit
 EndIf
EndIf
; your code for download

You're right:

If the file cannot be deleted then error (I didn't thought at that!). 

Then if it's ok, go to download.

You're welcome. It's important writing correct and robust simple code: not only is it important per se, but it also greatly help when you're into more complex pieces of software. If you don't force you early into good habits, you're easily lost when things get more involved. This is completely orthogonal to the language and has even broader applications than just languages and computers.
